Privacy Policy: Prime Solutions EL

Advertise only: nothing is sold on this website, and no orders or payments are taken here. Any work is agreed in writing before it starts.

In short

This website has no forms, no cookies, no analytics and no tracking. It does not ask you for anything.
We only get your personal information if you choose to email or WhatsApp us, or if you later become a client.
We use it to reply to you, give you a quote and, if you go ahead, build your website. We do not sell it and we do not send marketing.
Only the business owner and people helping with your project see it. Our email is provided by Google (Gmail) and WhatsApp is run by Meta.
You can ask to see, correct or delete your information, and you can complain to the Information Regulator.

1. Who we are

The responsible party for your personal information is HAMZA KHAN, a sole proprietor trading as Prime Solutions EL, East London, South Africa, email primesolutionsel@gmail.com. "Responsible party" is the person who decides how your information is used under the Protection of Personal Information Act 4 of 2013 (POPIA). In this policy, "we" and "us" mean Prime Solutions EL.

2. What we collect

When you email or WhatsApp us: your name, your email address or phone number, and anything you choose to tell us about your business or project. Please do not send sensitive information (such as health, religion, biometrics or criminal history) or information about children.
If you become a client: the details you give us to build your website, such as your business name, contact details, text, logo and photos, and what we need to send you a quote, agreement and invoice.
Server logs: our web host, Cloudflare, may automatically record technical details such as your IP address, the date and time, the page asked for and your browser type.
Nothing else: this website has no forms, sign-up, login, cookies, local storage, analytics, payments, or content loaded from other companies. The WhatsApp link only opens WhatsApp when you click it; nothing is loaded from WhatsApp until then.

3. Why we use it, and on what basis

To reply to your enquiry, by email or WhatsApp, and, if you ask, prepare a quote. You contacted us and asked, and we have a genuine interest in answering the people who write to us (POPIA section 11(1)(b) and (f)).
If you become a client, to carry out the agreement with you: build and hand over your website, send invoices and keep the records the law requires.
Server logs are used only to keep the site running and secure.
We do not send marketing, and we will not use your details for anything else without telling you first.

4. Who else sees it (third parties and tools)

Google (Gmail): provides our email and stores our messages for us as our operator. Google's servers may be outside South Africa.
WhatsApp (run by Meta): if you message us on WhatsApp, your messages, your phone number and your profile name are held by WhatsApp under its own terms and privacy policy, and by us. Its servers may be outside South Africa. We use WhatsApp only to reply to you. We do not add you to groups or broadcast lists, and we do not send marketing.
Our web host (Cloudflare): sees server logs only, to deliver and protect this website. Its servers may be outside South Africa.
If you become a client: the form tool we use to collect your website details (Tally, which stores data in the European Union), and the private online storage where we keep your website files while we build them (GitHub, whose servers may be outside South Africa). They act for us and handle your information under their own terms. We tell you which tools we use before you send anything.
We do not sell your information and we do not share it with anyone else unless the law requires it.
Where information is stored outside South Africa, we rely on POPIA section 72 for the transfer.

5. How long we keep it

Enquiries (emails and WhatsApp messages) that do not lead to any work: deleted after 12 months from our last contact.
Working details you send us to build your website (such as your photos and logo): deleted 30 days after we hand over your finished website, except where the law or your agreement says we must keep a record.
Your agreement, sign-off, consent record and invoices: kept for 5 years, because business and tax records must be kept.
The code and text of a finished website: kept for 3 years in case we need to fix or explain our work, without your photos and logos.
Server logs: kept by Cloudflare only as long as it needs them for security, under its own terms.

After these periods, we delete the information or make it anonymous.

6. How we protect it

We keep your emails and messages in password-protected accounts that only the owner and people helping with your project can access, and this website uses HTTPS. No system is completely secure. If we believe your information was accessed without permission, we will tell you and the Information Regulator as POPIA section 22 requires. We run our business from East London, South Africa; some of our tools store information outside South Africa, as set out in section 4.

7. Your rights

Under POPIA you can ask us to tell you what personal information we hold about you, give you a copy, correct it, delete it, or stop using it (POPIA sections 5, 11(3), 23 and 24). You can also ask us to stop contacting you for marketing, although we do not send any. To make a request, email primesolutionsel@gmail.com with the word PRIVACY in the subject line, or message us on WhatsApp starting with the word PRIVACY. We may need to check it is really you. We aim to reply within 30 days.

8. Complaints

Please contact us first at primesolutionsel@gmail.com, with COMPLAINT in the subject line, or on WhatsApp at +27 71 863 4356, starting your message with COMPLAINT. You may also complain to the Information Regulator (South Africa):

9. Children

This website is for adults and businesses. We do not knowingly collect information about anyone under 18. If you think we have, tell us and we will delete it.

10. Changes

If this website changes what it collects or how it uses information, we will update this policy first and change the "last updated" date.
